Data Protection Policy


Bio Hydro Kuwait  (hereinafter “BH”) takes the protection of your personal data very seriously. Personal data shall mean any information relating to an identified or identifiable natural person, for example name, address, email-address, age, birthday or credit card data. When we process the personal data that is collected during your visit to our website, we always consider the applicable data protection laws. Your personal data will not be disclosed, nor transferred to any third parties without legal authorization. In the following sections, we explain what types of data we record when you visit our website and how they are used:

1. Recording and processing of data in connection with access over the Internet

Our websites are exclusively hosted by our data processor Shopify.com, Hauptstraße 68, 02742 Friedersdorf, Germany, on web servers in Germany. Personal data is only recorded for the purposes to allow use of the website (connection setup) and for technical administration of the network infrastructure. The configuration of our web server allows no logging of personal data while surfing, especially no IP addresses.

Except from the special cases said above, we do not process personal data without obtaining your prior explicit consent. Pseudonymous user profiles can be created as stated under web analysis (see below).

2. Orders

If you order information material or other goods via our website, BH will use the data provided only for the purpose of processing your order.

3. Use and transfer of personal data

All use of your personal data is limited to the purposes stated above, and is only undertaken to the extent necessary for these purposes. Your personal data is not disclosed to third parties. Personal data will not be transferred to government bodies or public authorities except in order to comply with mandatory national law or if the transfer of such data should be necessary in order to take legal action in cases of fraudulent access to our website. Personal data will not be transferred for any other purpose.

4. Consent to use data in other contexts

The use of certain services on our website, such as newsletters or forums, may require prior registration and requires more processing of personal data, such as long-term storage of e-mail addresses, user IDs and passwords. We use such data only if it has been sent to us by you and if you have given us your prior express consent. For example, we request your consent separately in the case of sending newsletters.

5. Cookies

We use session cookies and temporary cookies on our websites, in particular for technical session-control, plug-ins or saving language settings. Cookies are small text files that are stored locally in the cache memory of the site visitor’s web browser. Session cookies are automatically erased when you close your browser. If, exceptionally, an application requires the storage of personal data in a cookie, for instance a user ID, we will inform you and, if mandatory by law, ask for your consent.

Of course, it is possible to visit our websites without the use of cookies. Please be aware, however, that most web browsers are configured to accept cookies per default. You can prevent this by changing the settings in your browser options. If the browser refuses all cookies, this may restrict the use of certain functions on our website.

6. Web analysis

User profiles with personal data are not created. However, Section 15 (3) of the German Telemedia Act (TMG) permits the use of user profiles under a pseudonym for the purpose of advertising, market research and the structuring of offers for the user if the user does not opt-out.

We also use web analysis services on our websites from Google Inc., USA, which acts as a data processor on behalf (see the website of www.google.de/analytics). These services have been checked by the data protection supervisory authorities and can be provided in a way that fulfills the requirements under German and European data protection laws (including IP- anonymisation and browser plug-in to opt out).

Using the technology of Google, data is collected and stored through our website. From this data, user profiles are produced under a pseudonym for marketing and optimization purposes. Cookies may be used. They enable the web browser to be recognized. Furthermore, user behaviour can be measured via a JavaScript code and data collected in this connection can be sent directly to Google’s servers in Germany or the EU via a HTML connection, exceptionally in the USA.

Without your prior express consent, the data collected using the tracking technologies will not be used to personally identify you and will not be combined with other personal data by BH. No cross-website analysis will be carried out.

If the tracking shall be stopped, you can deactivate JavaScript and cookies in your web browser. Consent for the collection and storage of data can also be refused with effect for the future at any time. 7. Social plug-ins

We also use social plug-ins in some cases, e.g. from Facebook, Twitter, YouTube, Google+ or Amazon. These platforms are often technically operated in the USA or in other countries outside Germany and the EU and only some are offered via national companies in the EU (see the websites www.facebook.de, www.twitter.de, www.youtube.de, www.google.de or www.amazon.de for the providers). The plug-ins are identified with the companies’ logo, comment fields or »Like« or »+1« buttons.

If you open a page of our website containing such a plug-in, your web browser will create a direct HTML connection to the servers of the respective provider in the country concerned.

By incorporating the plug-ins the provider will get at the least the information that you have visited a certain page, and perhaps also other information that your web browser or the device discloses. The content of the plug-in is loaded by your web browser directly from the provider and incorporated into our website. If you are registered and have logged in with the respective provider, your visit can also be assigned to your user account.

If you interact with a plug-in, e.g. if you click on a »Like« button or enter a comment in a form field, your browser will also transmit this information directly to the provider where it will be saved and, if applicable, continue to be used and published.

The reason for the collection and use of the data as described are marketing measures of the provider and KAVAJ. For more details and your rights and ways in which you can prevent the collection and use of data in order to protect your private sphere you should also visit the data privacy policy of the respective provider.

If you do not wish a provider to collect data on you through our website you must deactivate the plug-ins in your web browser. If you wish to avoid a link to any existing user account, you must log out before your visit our website.

8. Security

BH implements technical and organizational security measures to protect personal data against inadvertent or deliberate manipulation, loss or destruction and against access by unauthorized persons. Our security measures are continuously improved in line with technological progress.

9. Links to websites operated by other providers

Our websites may contain links to other websites. This data protection policy applies exclusively to the websites managed by BH. We have no way of influencing data processing of other providers, nor do we carry out any checks to ensure that they conform with the relevant laws.

10. Right to information and contact data

You have a right to inspect any stored personal data concerning your person, and also the right to demand their correction or deletion, and to withdraw your consent for future use.

11. Acceptance, validity and modification of this data protection policy

By using our website you agree to accept the use of your personal data as specified above. This present data protection policy came into effect on 01.05.2014. As our websites evolve and new technologies come into use, it may become necessary to amend this policy. BH reserves the right to modify its data protection policy at any time, with effect as of a future date. We recommend that you re-read the latest version from time to time.

12. Facebook „Custom Audiences“

On our site we use Facebook’s “Custom Audiences” remarketing tool. With this tool and utilizing diverse web technologies such as cookies or web beacons, Facebook can collect information about our visitors and anonymously assign it to Facebook profiles where appropriate. As the operator of the site, we do not have access to the data collected by Facebook, though we can use the information that Facebook automatically and anonymously generates via “Custom Audiences” to deliver customized ads on Facebook. Visitors to our site have the option of disabling the Facebook “Custom Audiences” remarketing tool.
